What are the rules

Renting out a property that is for sale

  • The licence is valid for 5 years.
  • You cannot renew the licence.
  • You cannot rent out more than 2 flats or living spaces at the same time.

Renting out living space in an empty building

  • You may rent out an empty building as residential accommodation for up to 10 years. For example, a space in an office or school.
  • You will first be granted a licence for two years. You can renew it a maximum of eight times for one year.

Requirements for the rental agreement

  • It is up to you to decide how much rent you charge. The local authority determines the maximum rent through the point system for rental properties.
  • The tenant has a minimum notice period of one month. The landlord has a minimum notice period of three months.
  • The lease will automatically end when the licence expires.
  • The rental agreement is written on paper. The contract clearly states temporary letting under the Vacant Property Act. The contract also states that the landlord has a licence and until when this licence is valid.

Does the rental agreement not meet these requirements?

As a landlord, you run the risk of the rental being treated as normal rental. In that case, the rules for normal rentals apply.
