Notice of proposed sale of land and water

The City of Leeuwarden plans to enter into a purchase agreement with a party for a plot of land and a parcel of water at De Leijte 4 in Hempens.

One serious candidate

Due to a ruling by the Supreme Court, the municipality must give equal opportunities to interested parties when issuing land. A selection procedure is not necessary if it has been established in advance or can reasonably be assumed that only one candidate will be eligible for the land. The municipality believes that in this case the exception rule as stated in the judgment applies and there is only one serious candidate for the following reason.

The local authority has already reached an agreement with all residents of houseboats in De Leijte harbour in 2016 for those residents to take ownership of the water bottom and adjacent shore plot of their houseboats. The agreements made are an extension of the local authority land policy. Previously, residents paid a municipal levy on encroachments for land and mooring to the local authority. They own their houseboats themselves.

The residents of the houseboat in question now want to work with the local authority to finalise the agreements made at the time. They made investments in their houseboat and the adjacent shore plot partly on the basis of that agreement. The local authority therefore considers that there is only one serious bidder in this case.
