Social assistance recovery payment
Does your ex-partner receive a social benefit? Or your young adult child? If so, the local authority will look into whether you can contribute to the maintenance of your ex-partner and child(ren). We call the payable amount the social assistance recovery payment.
Why we ask for a social assistance recovery payment?
People only receive social benefits if they do not have enough money to cover their cost of living. These are costs such as food and drink, clothing, rent, gas, water, electricity, health insurance and children’s study costs.
Spouses and registered partners are required by law to support each other. This is called the maintenance obligation. This maintenance obligation remains in place following a divorce. The parents’ maintenance obligation also applies to recognised children up to 21 years of age.
How the social assistance recovery payment is calculated
The local authority operates nationwide rules to calculate your social assistance recovery payment.
The local authority does this by examining your income and expenditure. The local authority will ask you to fill in the Verhaal form (recovery payment form) for this purpose. After the investigation, you will receive a letter. This states the amount you have to pay and how you pay it.

- Online: Complete the online Recovery form (opens in new tab). You will need DigiD for this.
- In writing: Download and complete the form Verhaal PDF (opens in new tab). Send the form to the City of Leeuwarden. You can also hand it in at the Town Hall.
Maintenance and the social assistance recovery payment
Do you pay maintenance? If so, the local authority will include this in the calculation of the recovery payment. Have you not yet arranged the maintenance? In that case the local authority can force your ex-partner to claim maintenance through the courts.
Your situation or income has changed
Contact the City of Leeuwarden and ask for an adjustment to the recovery payment. Or complete the above form. We use this information to recalculate your recovery payment.
Unable to pay the established social assistance recovery payment
If you are not able to pay the social assistance recovery payment, or if you have questions, contact us as soon as possible. We would be happy to consider your situation with you and try to find a suitable solution.
What happens if you do not pay the social assistance recovery payment?
If you have not paid the social assistance recovery payment and have not been in contact with us, the local authority can take this matter to court. The court will determine your recovery payment. In some cases, the local authority may impose an attachment on your income. Additional costs may be associated with this. These costs will be at your expense.
