What is laid down in the Data Processing by Partnerships Act (Wgs)?

The Data Processing by Partnerships Act (Wgs) came into force on 1 March 2025. This law helps government organisations work more effectively together against fraud and organised crime. Each government organisation has its own rules for sharing personal data. This makes working in partnership difficult. The Act explains how government organisations are permitted to share personal data. This is only permitted if it is absolutely necessary for their work.

The Act contains a few important rules. For example, that the RIEC partnership:

  • Is only permitted to use personal data to combat organised crime. For example, drug crime, human trafficking, fraud and money laundering.
  • Personal data may only be used for the purposes specified by law.
  • Always check whether it is actually necessary to use personal data and whether there is no other way to achieve the same goal.
  • There must be a contact point where you can ask questions about the RIEC partnership’s use of your personal data.
  • An independent regulator must be appointed to coordinate the joint regulators. They check whether the RIEC partnership complies with privacy rules.
